"Differences between the US civil jury trials compared with German civil litigation"


On September 5th and 6th, 2014 the German-American Lawyers Association (“DAJV”) will present at its annual conference in Berlin for the first time a mock trial to address the characteristics of US civil jury trials. To this end, a group of specialized US advocates and judges, who are members of the American Boerd of Trial Advocates, has been invited to come to Berlin to show in a mock trial as realistic as possible the interaction of US advocates and judges in civil trials which are decided by a jury. The mock trial will be held at the Kammergericht (Court of Appeals) on September 5th, 2014 from 9.00 a.m. until 5.20 p.m. in English and shall be opened by an address of the President of the Kammergericht, Ms. Nöhre.

On Saturday, September 6th, 2014 a panel discussion has been scheduled with the US trial attorneys and judges at the Konrad-Adenauer-Foundation with the participation of Dr. Marc Eumann, LLM, Presiding Judge at the Bonn District Court, and Professor Dr. Gerhard Wagner, LLM, Humboldt University Berlin and the aim of a legal comparison of both jurisdictions. The moderatior of this session is Dr. Rolf. M. Winkler, LL.M., Partner of Haver & Mailänder, Stuttgart.

Future Limitation of the German Objection against Applications for the Presentation of Documents in the phase of „pre-trial discovery“ in cases of Legal Assistance with the United States?


Rechtsanwalt Dr. Rolf M. Winkler, LL.M. heads in the afternoon of 16 June 2014 in Frankfurt/Main a lecture and discussion meeting on the eventual future limitation of the German objection with regard to applications for legal assistance of US-American Courts pursuant to the Hague Convention on the Taking of Evidence abroad in Civil and Commercial Matters aiming at the “pre-trial discovery” of documents. The German Ministry for Justice and Consumer Protection (BMJV) started a new initiative to change the general objection of the German Federal Republic in 1979 against the “pre-trial discovery” of documents. There are controversial opinions in German legal literature and also by German companies with regard to the initiative of the BMJV which shall be discussed on 16 June 2014 by the participants of the meeting and a.o. by the following speakers: Professor Dr. Joachim Zekoll, LL.M. (Berkeley), of the Goethe-University in Frankfurt/Main, the Presiding Judge at the District Court of Frankfurt/Main Thomas Kehren and Michael Guntersdorfer, Corporate Legal Counsel of Infineon Technologies AG, Munich. Lecture before the Strasbourg Chamber of Commerce on the Freedom to Provide Services in Germany


Setting up a machine, establishing an IT-network, performing services in enterprises, working on construction sites – all these activities need the respect of German rules and sometimes of certain formalities, even if they are carried out by French enterprises in Germany. On 11 June 2014 Dr. Thomas M. Grupp gives a lecture before the Chambre de Commerce et d’Industrie (Chamber of Commerce) in Strasbourg concerning the Freedom to provide services in Germany („La libre prestation de services en Allemagne“).
