DIS40 Stuttgart: Ideas to Reform the DIS Arbitration Rules

The German Institution of Arbitration (DIS) has recently started a process to reform the provisions of its Arbitration Rules of 1998. The DIS40 supports this reform process and has initiated an event series in all DIS40 regional groups under the topic “Ideas to Reform the DIS Arbitration Rules”. In the course of the event series, ideas and proposals shall be developed on how the reformed Arbitration Rules may look like in order to be able to compete with rules of other arbitral institutions. The DIS40 Stuttgart will also organize a workshop in this series.

Dr. Roland Kläger is regional coordinator of the DIS40 Stuttgart and moderator of the event.

DIS40/HK45: Arbitration in Asia

The German Initiative of Young Arbitrators (DIS40) and the Young Practitioners Group of the Hong Kong International Arbitration Centre (HK45) invite to a panel discussion on “Arbitration in Asia”. The speakers Prof. Dr. Yuanshi Bu, Dr. Nicolas Wiegand and Dr. Lars Markert present cultural and legal particularities in arbitration proceedings in China, Hong Kong and Japan and discuss recent developments and challenges at these important arbitration venues in the Far East.

Dr. Roland Kläger is regional coordinator of the DIS40 Stuttgart and moderates the panel discussion.

Event of the Regional Group Brussels of the Studienvereinigung Kartellrecht e.V.

With its cartel proceedings against HRS, Booking.com and Expedia and its prohibition of the best-price-clauses used by these online booking portals, the German Federal Cartel Office (FCO) has broken new grounds in EU and German competition law. The FCO rejected the booking portals’ argument that the best-price-clauses were necessary in order to avoid an alleged “free-riding” problem. And unlike the competition authorities in other EU Member States, the FCO did not accept the commitments that the booking portals had offered during the proceedings. The FCO’s decisions have therefore created a furore in Germany and abroad and have raised a number of legal and practical questions.

Dr. Volker Soyez – Partner in our competition law practice group and managing partner of the Brussels office of Haver & Mailänder – will speak on this topic at the next gathering of the Studienvereinigung Brüssel e.V. Regionalgruppe Brussels. Dr. Soyez represented the German Hotel Association in the various proceedings.

By 18 April, 2016, three new EU Directives on Public Procurement will be implemented in German public procurement law – the largest procurement reform for 10 years. The public procurement rules have been revised and modernised in order to increase efficiency of public spending, facilitating the participation of tenderers. The Staatsanzeiger conference takes the view of officials in charge of municipal procurement. Dr. Alexander Hübner will speak about public procurement effects of projects financed by EU or Member State funds and the impact of state aid in public procurement procedures.

The procurement rules have been revised and modernised in order to increase efficiency of public spending, facilitating the participation of tenderers. forum vergabe e.V., Berlin, hosts an expert conference on the key changes to come. Among other procurement experts, e .g. from the Federal Ministry for Economic Affairs and Energy, Berlin, and the German Federation of municipalities, Bonn, Dr. Alexander Hübner will speak about relevant exclusions from procurement law application and modifications of contracts during their term.
