Das neue nationale Vergaberecht im Überblick

In February 2017, the new German procurement rules (Unterschwellenvergabeordnung – UVgO) on public procurement of supplies and services with an estimated contract value below the EU-threshold (209,000 EUR) was released. The UVgO rules will replace the well-known VOL/A regime and provide a bundle of new provisions. The changes address all relevant aspects from the very start until the completion of a procurement procedure.The conference hosted by IHK Auftragsberatungsstelle Baden-Württemberg bei der Industrie- und Handelskammer Region Stuttgart will be chaired by Dr. Alexander Hübner.

Symposium für Vergaberecht

Three new EU Directives on Public Procurement have been implemented in German public procurement law since 18 April, 2016 – the largest procurement reform for 10 years. The public procurement rules have been revised and modernised in order to increase efficiency of public spending, facilitating the participation of tenderers. The impact on the procurement practice is on the agenda of the Symposium für Vergaberecht. For the first time, the entire procurement procedure is comprehensively laid down in the German Antirust Code (Gesetz gegen Wettbewerbsbeschränkungen – GWB). Dr. Alexander Hübner will speak about the experience with the new GWB rules from a practitioner’s perspective.

DIS40 Stuttgart: Disputes arising from shareholders‘ resolutions – typical conflicts, legal actions and arbitrability

The German initiative of young arbitrators (DIS40) invites to a discussion roundtable on disputes arising from shareholders‘ resolutions. For such disputes, the DIS provides the Supplementary Arbitration Rules for Corporate Law Disputes. As the German Federal Supreme Court has recently amended its case law regarding disputes arising from shareholders‘ resolutions, it is worth taking a closer look at how such disputes are handled in practice before state courts and arbitral tribunals. 

Dr. Roland Kläger is head of the DIS40 Stuttgart group and moderates the event.

DIS40/CEA-40: Cross Examination Techniques - Dos and Don’ts in Common Law vs. Civil Law Jurisdictions

The German Initiative of Young Arbitrators (DIS40) and the Young Practitioners Group of the Spanish Arbitration Club (CEA-40) jointly invite to a seminar on Cross Examination Techniques and how such Common Law concepts are applied in the international arbitration practice in Civil Law countries such as Spain and Germany. Experienced international arbitration practitioners from the UK, Spain and Germany will share their dos and don’ts of how to succeed in cross examination and will discuss differences and commonalities in the practice of the respective countries. 

Dr. Roland Kläger is head of the DIS40 Stuttgart group and organizes the event.

Leipziger Gespräche zum Verkehrsmarktrecht Änderung der Verordnung (EG) Nr. 1370/2007: Neuerungen für den Eisenbahnsektor

In December 2017, important amendments to Regulation (EC) No 1370/2007 on public passenger transport services by rail and by road will enter into force. The first amendments since 2007 mainly deal with the rail sector and raise numerous legal issues. At the same time, the amendments give reason to challenge the legal concept and the procurement practice of public passenger transport services. Against this background, the Forschungsstelle für Verkehrsmarktrecht at Friedrich-Schiller-Universität Jena (Prof. Dr. Matthias Knauff, LL.M. Eur.) and the chair in public and administrative law (Staats- und Verwaltungsrecht sowie Medienrecht) of the University of Leipzig (Prof. Dr. Hubertus Gersdorf) kindly invite to the 1. Leipziger Gespräche zum Verkehrsmarktrecht, a conference kindly supported by Deutsche Bahn AG and HAVER & MAILÄNDER Rechtsanwälte. Dr. Alexander Hübner will speak about current developments in public procurement and procurement review law from a practitioner’s view.
